“We” and “us” mean Kane Painting LLC. “You” means anyone using the site.
These terms cover the website, not your painting job. The work itself is governed by the written proposal you sign with us. If anything here conflicts with your signed proposal, the proposal wins.
Using the site
You may browse the site, request an estimate, and share our pages. You agree not to:
- Use the site for anything unlawful, or to harass or harm anyone
- Submit false information, or pretend to be someone else
- Copy, scrape, or republish our content or photos for your own business
- Try to break into, overload, or interfere with the site
- Upload anything containing malware
We can restrict access to the site if someone is misusing it.
Estimates and quotes
Asking for an estimate does not create a contract, and neither does receiving one. It means we will get in touch and take a look at the job.
- Estimates are free and come with no obligation.
- An estimate is valid for the period stated on it. Prices can change after that.
- Pricing depends on what we find at the property. If the scope changes once work begins, the price may change, and we will talk to you before it does.
- Work begins only after you accept a written proposal.
Our work and warranty
We offer a two year warranty on our workmanship. The details and exclusions are set out in your proposal, because they depend on the surfaces, products, and conditions of your specific job. Read that document for the terms that actually apply to you. Nothing on this website changes or extends it.
Paint manufacturers provide their own separate warranties on their products. Those are between you and the manufacturer.
Text messages
If you give us your mobile number and agree to receive texts, we may message you about your estimate, schedule, and project, and occasionally about offers. Message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help. Agreeing to texts is not a condition of hiring us. Carriers are not liable for delayed or undelivered messages.
Our content
Everything on this site, including the text, project photos, logo, and design, belongs to us or is used with permission. You may not reuse it for commercial purposes without our written permission. You are welcome to link to our pages.
The project photos show real work we have completed. Results vary with the surface, the products chosen, and the condition of the property, so treat them as examples rather than a promise of an identical outcome.
Anything you send us
If you send us photos, reviews, or comments, you keep ownership of them. You give us permission to use them to market our business, including on this site and on social media. You confirm you have the right to share whatever you send, and that it is not somebody else’s work.
If you would rather we stopped using something you sent, email us and we will take it down.
Other companies’ services
Parts of this site rely on outside services, including our estimate form, our newsletter sign up, the map in the footer, and links to our social profiles. Those companies have their own terms and privacy policies. We do not control them and are not responsible for them.
The site is provided as is
We work to keep the site accurate and available, but we cannot promise it will always be online, error free, or fully up to date. Content here is general information about painting, not professional advice for your specific property. To the fullest extent the law allows, we provide the site without warranties of any kind.
Limits on our liability
To the fullest extent Ohio law allows, we are not liable for indirect, incidental, or consequential damages arising from your use of this website. If we are found liable for anything connected to the site, our total liability is limited to $100.
This limit applies to the website. It does not limit our responsibility for the painting work itself, which is covered by your proposal, our warranty, and our insurance. It also does not exclude anything that cannot legally be excluded, including liability for fraud or for death or personal injury caused by negligence.
Indemnification
If your misuse of this site, or your breach of these terms, causes a claim against us, you agree to cover the reasonable costs and legal fees that result.
Governing law
These terms are governed by the laws of the State of Ohio, without regard to conflict of law rules. Any dispute about the site will be handled in the state or federal courts serving Summit County, Ohio, and you agree to that venue.
Changes to these terms
We may update these terms from time to time. The date at the top shows the current version. Continuing to use the site after a change means you accept the updated terms.
If part of this does not hold up
If a court finds any part of these terms unenforceable, the rest stays in effect. If we do not enforce something right away, that does not mean we have given up the right to enforce it later.
